The influx of immigrants has led to extensive political, social, and employment-related debates. The IRCA, enacted in 1986, requires that employers verify the employment eligibility status of all employees, while not discriminating because of national origin or ethnic background. Regardless of company size, every employer must comply with the provisions of the act and may not knowingly hire unauthorized workers for employment in the United States.
Within the first three days of employment, each employee must complete an Employment Eligibility Verification (commonly called an I-9) form and provide documents proving that he or she is legally authorized to work in the United States. The employer is required to inspect the documents and maintain records for all new hires. The E-Verify federal database instantly verifies the employment eligibility of employees. Federal contractors are required to use the system, as are employers in a number of states where it has been mandated. Other employers may use the system to check and verify employees' legal status.
