The Answer is Both Title VII and Section 1981 provide a basis for an employee to sue for race discrimination in employment.However,the process is different.Title VII requires the employee to file a claim with EEOC prior to filing a lawsuit.Also,the EEOC can go to court on behalf of the complainant.This method ensures access because there is no fee to file a claim with EEOC and it is possible to get the case to court without having to hire lawyer.However,Section 1981 is a private right of action and the employee must hire an attorney to pursue a claim under this statute.Therefore,some people may not be able afford filing a claim under Section 1981.This lack of resources was a significant factor in the limited use of Section 1981 by blacks during the period between the post-Civil War era and the passage of Title VII in 1964.On the other hand,Section 1981 has a longer statute of limitation than Title VII so that a claimant who has a claim that is barred by the 180 day statute of limitations for filing Title VII claims can still use Section 1981.
